Terms of Use

Although all the clauses contained in this agreement are standard clauses about software products, it is advised that you read them entirely.

This End-User License Agreement ("EULA") constitutes an agreement between you and PeakWatch (herein referred to as the "Owner") with regard to the PeakWatch application for Mobile Phones (herein referred to as "Software Product" or "Software"). By installing the Software, you are agreeing to be bound by the terms of this license agreement.

Your use of the Software (as specified below) is subject to the terms and conditions set forth in this EULA. If you do not accept the terms of this EULA, do not install or use the Software.

  1. LICENSE. The Software is licensed, not sold. The Owner grants you a non-exclusive, non-transferable, non-sublicensable, limited right and license to use one copy of the Software for your personal non-commercial use on a single device. The rights granted herein are subject to your compliance with this EULA. The Software is being licensed to you and you hereby acknowledge that no title or ownership in the Software is being transferred or assigned and this EULA is not to be construed as a sale of any rights in the Software.

  2. RESTRICTIONS OF USE. Unless the Owner has authorized you to distribute the Software, you shall not make or distribute copies of the Software or transfer the Software from one device to another. You shall not decompile, reverse engineer, disassemble, include in other software, or translate the Software, or use the Software for any commercial purposes. You shall not modify, alter, change or otherwise make any modification to the Software or create derivative works based upon the Software. You shall not rent, lease, resell, sub-license, assign, distribute or otherwise transfer the Software or this license. Any attempt to do so shall be void and of no effect.

  3. COPYRIGHT. You acknowledge that no title to the intellectual property in the Software is transferred to you. You further acknowledge that title and full ownership rights to the Software will remain the exclusive property of PeakWatch, and you will not acquire any rights to the Software. You shall not remove or obscure the Owner's copyright, trademark or other proprietary notices from any of the materials contained in this package or downloaded together with the Software.

  4. DISCLAIMER OF WARRANTY. The Software is provided "AS IS", without warranty of any kind. We disclaim and make no express or implied warranties and specifically disclaim the warranties of merchantability, fitness for a particular purpose and non-infringement of third-party rights. The entire risk as to the quality and performance of the Software is with you. We do not warrant that the functions contained in the Software will meet your requirements or that the operation of the Software will be error-free.

  5. LIMITATION OF LIABILITY. In no event will the Owner be liable for special, incidental or consequential damages resulting from possession, access, use or malfunction of the Software, including but not limited to damages to property, loss of goodwill, computer or mobile device malfunction and, to the extent permitted by law, damages for personal injuries, property damage, lost profits or punitive damages from any causes of action arising out of or related to this EULA or the Software, whether arising in tort (including negligence), contract, strict liability or otherwise and whether or not the Owner has been advised of the possibility of such damages.

Because some states/countries do not allow certain limitations of liability, this limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction. This limitation of liability shall not be applied solely to the extent that any specific provision of this limitation of liability is prohibited by any federal, state, or municipal law, which cannot be pre-empted. This EULA gives you specific legal rights, and you may have other rights that vary from jurisdiction to jurisdiction. In no event shall the Owner's liability for all damages (except as required by applicable law) exceed the actual price paid by you for use of the Software.

  1. PRIVACY AND ADVERTISING. You can find our Privacy Policy on our website or in our application.It is advised that you read them entirely.

  2. INDEMNITY. You agree to indemnify, defend and hold the Owner harmless from and against any and all damages, losses, and expenses arising directly or indirectly from: (i) your acts and omissions to act in using the Software pursuant to the terms of the EULA; or (ii) your breach of this EULA.

  3. CHANGES. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. Any changes we may make to our privacy policy in the future will be posted on this page. You should check this page from time to time and take note of any changes.

  4. MEDICAL DISCLAIMER. The Software is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health providers with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have seen in this Software. If you think you may have an emergency, call your doctor, go to the emergency department, or call emergency immediately. Reliance on any information provided by PeakWatch or our employees is solely at your own risk.

  5. SUBSCRIPTIONS. PeakWatch is free to download. Should you choose to upgrade to PeakWatch Pro, we offer monthly and annual auto-renewing subscription options.

Payment will be charged to your credit card through your iTunes account at confirmation of purchase. Subscription renews automatically unless canceled at least 24 hours before the end of the subscription period.

Subscriptions can be managed and auto-renewal turned off in Account Settings in iTunes after purchase. Once purchased, refunds will not be provided for any unused portion of the term.

紹介および報酬プログラム

PeakWatch は、友達招待、紹介登録、特典の贈与、メンバーシップ報酬、またはこれらに類する活動（以下「紹介および報酬プログラム」といいます）を随時提供する場合があります。紹介および報酬プログラムに参加することにより、ユーザーは本補足条項、および PeakWatch が App 内、活動ページ、またはその他合理的な場所で公表する具体的な活動ルールに同意したものとみなされます。

本補足条項は、紹介および報酬プログラムにおけるユーザー特典の範囲、資格判定、例外処理、および責任分担を説明することを目的としています。具体的な参加方法、入口、報酬内容、報酬条件、有効期間、および引き換え方法は、PeakWatch App 内で実際に表示される活動ルールに従うものとします。

紹介関係と資格

ユーザーは、PeakWatch が提供する招待コード、招待リンク、またはその他指定された方法を通じて紹介および報酬プログラムに参加するものとします。紹介は、システムが紹介関係を正常に識別および記録し、紹介者と招待されたユーザーの双方が適用される活動条件を満たした場合にのみ有効とみなされます。

PeakWatch は、アカウント状態、サブスクリプション状態、デバイス情報、登録記録、支払いまたは返金記録、活動参加記録、システムログ、地域ポリシー、プラットフォーム規則、およびリスク管理結果に基づき、紹介関係が成立しているか、招待されたユーザーに資格があるか、報酬を発行すべきかを判断する権利を有します。

同一の招待されたユーザーは、通常、同種の紹介報酬活動に一度だけ参加でき、有効な紹介関係を確立できる紹介者は一人のみです。同一ユーザーが複数の招待コードまたは招待リンクを使用した場合、PeakWatch は、システム記録、紐付け時刻、最終的に入力された招待コード、またはその他合理的な規則に基づき、有効な紹介関係を判断することがあります。

報酬の発行と特典の制限

紹介報酬には、PeakWatch Pro の無料利用期間、App 内機能特典、メンバーシップ特典、割引、ポイント、または PeakWatch が随時公表するその他の特典が含まれる場合があります。具体的な報酬は、該当する活動ページに表示される内容に従います。

報酬は、PeakWatch が紹介を有効と確認した後に発行されます。システム処理、サブスクリプション状態の同期、ネットワーク環境、第三者プラットフォームサービス、またはリスク管理審査により、報酬の反映が遅れる場合があります。

PeakWatch が明示的に定める場合を除き、紹介報酬に現金価値はなく、現金への交換、販売、譲渡、貸与、質入れ、相続、返金、または現金相当価値への引き換えはできません。報酬は、有効期間、アカウント状態、サブスクリプション状態、地域制限、プラットフォームポリシー、またはその他の利用条件の対象となる場合があります。

例外処理

PeakWatch は、以下のいずれかに該当する場合、関連する報酬の発行を拒否、停止、取消、調整、または回収する権利を有します。

  1. 紹介関係がシステムに正常に記録されていない、または確認できない場合；
  2. 紹介者または招待されたユーザーが活動資格要件を満たさない場合；
  3. 招待されたユーザーが登録を取消し、アカウントを削除し、返金を受け、サブスクリプションを取り消し、または異常なアカウント行為を行った場合；
  4. ユーザーが本規約、活動ルール、適用法令、または第三者プラットフォーム規則に違反した場合；
  5. App Store、決済プラットフォーム、第三者サービス、システムエラー、ネットワーク問題、法令またはポリシー上の制限、不可抗力により、報酬を正常に発行または継続提供できない場合。

ユーザーが紹介関係、資格判定、または報酬発行結果について疑問を有する場合、PeakWatch が提供するカスタマーサポートまたはフィードバックチャネルを通じて当社に連絡できます。PeakWatch は、システム記録、活動ルール、および関連証拠に基づいて確認し、合理的な範囲内で対応します。

禁止行為

ユーザーは、不適切な手段により紹介および報酬プログラムに参加または操作してはなりません。これには以下が含まれますが、これらに限定されません。

  1. 虚偽アカウント、重複アカウント、大量アカウントの作成、または自己紹介；
  2. スクリプト、ボット、エミュレーター、自動化ツール、またはその他異常な方法による報酬の取得；
  3. 招待コード、招待リンク、アカウント、または報酬特典の売買、貸与、譲渡、交換；
  4. 虚偽広告、誤解を招く約束、PeakWatch 公式のなりすまし、または報酬内容の誇張による招待；
  5. 同意のないスパム、嫌がらせ、または宣伝メッセージの送信；
  6. 脆弱性、システムエラー、ルールの欠陥、または異常なプロセスを利用した不当な利益の取得；
  7. PeakWatch、他のユーザー、第三者プラットフォーム、または公共の利益を損なうその他の行為。

PeakWatch がユーザーによる上記行為を認定した場合、PeakWatch は当該ユーザーの紹介および報酬プログラムへの参加を制限し、関連報酬を取消、凍結、または回収し、アカウント特典を停止または終了し、法的責任を追及する権利を留保します。

データ利用とプライバシー

紹介関係の識別、報酬の発行、活動統計、カスタマーサポート、およびリスク管理のため、PeakWatch は、招待コード、招待リンク、アカウント状態、サブスクリプション状態、デバイス情報、活動参加記録、報酬発行記録など、紹介および報酬プログラムに関連する必要な情報を処理する場合があります。

PeakWatch は、プライバシーポリシーに従って当該情報を処理し、ユーザーデータの安全を保護するために合理的な措置を講じます。ユーザーは、紹介および報酬プログラムを通じて他人の個人情報を違法に収集、利用、開示、または配布してはなりません。

活動の変更、停止、および終了

PeakWatch は、製品運営、技術上の制限、リスク管理、プラットフォーム審査要件、法令、または事業上の取り決めに基づき、紹介および報酬プログラムを変更、停止、または終了する権利を有し、報酬内容、資格条件、発行ルール、有効期間、および引き換え方法を調整することがあります。

適用法により別途要求される場合を除き、PeakWatch は、活動の変更、停止、または終了により報酬が取得されない、引き換えられない、または無効となったことについて責任を負いません。すでに適用条件を満たし発行された報酬について、PeakWatch はユーザーが利用できるよう合理的な努力を行います。法令、プラットフォームポリシー、システムエラー、第三者の理由、または不可抗力により報酬を継続提供できない場合、PeakWatch は合理的な代替案を提供し、または対応する調整を行う権利を有します。
