Additional Terms

These Additional Terms apply to your use of PeakWatch's Food Log, AI Food Recognition, and Custom Recipes & Food Items features. They supplement and do not replace the main PeakWatch Terms of Service. If there is a conflict, these Additional Terms govern only to the extent they apply to the described features.

1. Scope

These Additional Terms apply when you use the Food Log, AI Food Recognition, and Custom Recipes & Food Items features in PeakWatch.

2. Description of Service

  • Food Log / AI Food Recognition: Allows you to record meals by uploading food photos or entering text descriptions. PeakWatch's AI analyzes content to estimate calories, macronutrients, and other nutrition information.
  • Custom Recipes & Food Items: Allows you to create, edit, and save custom food items and recipes (ingredient lists, serving sizes, names, notes) to your PeakWatch account for reuse.

3. Consent to Upload, Creation, and Processing

By using these features you consent to:

  • Uploading photos and/or entering text that will be transmitted to PeakWatch's servers for AI processing and analysis.
  • Automated processing of uploaded and entered content to generate nutrition estimates and related outputs.
  • Storage of processed results, and any custom recipes or food items you create, on PeakWatch's servers for account access and reuse.

You may stop using these features or delete related data at any time through the app controls described in Section 4 and Section 5.

4. Data Retention

  • Food Photos: Temporarily stored and deleted automatically after AI processing (typically within 24 hours).
  • AI-Generated Nutrition Data: Retained in your account until you delete the corresponding food log entry or delete your account.
  • Custom Recipes & Food Items: Persist on PeakWatch's servers and remain accessible in your account until you manually delete them or delete your account.
  • Aggregated/Anonymized Data: May be retained for analytics and service improvement without personal identifiers.

5. Deletion and Account Controls

  • You can delete individual food log entries, custom recipes, or any stored food items directly in the app.
  • For complete removal of all data associated with your account, use Settings → Privacy → Delete My Data or contact privacy@peakwatch.app.
  • Deletion requests will be processed in accordance with applicable laws; some backups or anonymized logs may persist for a limited time as required by law or for technical reasons.

6. Ownership and License

  • You retain ownership of the content you upload or create (including photos, descriptions, and custom recipes).
  • By uploading or creating content, you grant PeakWatch a limited, revocable, non-exclusive license to host, store, process, and display that content solely to provide, operate, and improve the Food Log and Custom Recipes features.

7. Accuracy and Limitation of Liability

  • Nutrition results are AI-generated estimates and may be inaccurate. They are provided for informational purposes only.
  • PeakWatch makes no warranties regarding the accuracy or completeness of nutrition estimates or user-created entries.
  • PeakWatch is not liable for any decisions (including health or medical decisions) made based solely on AI-generated nutrition results or user-entered data.

8. Security

  • Data is encrypted in transit (HTTPS) and at rest.
  • Access to user content is restricted to authorized systems and personnel under confidentiality obligations.

9. Third-Party Processing

  • PeakWatch may use trusted third-party service providers (including cloud and AI providers) to process uploads. These providers are contractually bound to process data only on PeakWatch's behalf and to meet confidentiality and security requirements.

10. Changes to These Additional Terms

  • PeakWatch may update these Additional Terms to reflect changes in features or legal requirements.
  • Updated terms will be posted in the app and at the official PeakWatch legal page. Continued use of the features after updates indicates acceptance.
